Mediation is an alternative dispute resolution method that aims to resolve disputes through negotiation before or during litigation. In certain labor, commercial, consumer and lease disputes, applying to mediation before filing a lawsuit is mandatory.
Application and Meetings
Mediation applications are made through the authorized mediation office. Parties may attend meetings personally or through their attorneys. Claims, offers and possible solutions are evaluated during the process.
Settlement or Non-Settlement
If the parties reach an agreement, settlement minutes are prepared. Under certain conditions, this document may have the effect of an enforceable document. If no agreement is reached, litigation may be pursued with the final minutes.
Why Preparation Matters
Before attending mediation, preparing claims, evidence, calculations and possible outcomes helps conduct the process efficiently.
